    Introduction:

     

    These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials relating to this Air Wick Prize Promotion (the ‘Prize Promotion’). Entry and claim instructions are deemed to form part of the Terms and Conditions and by participating, all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

    For the avoidance of any doubt, this Promotion is run by the Promoter only and not in any way endorsed, sponsored or administered by, or associated with, any other brand, company or organisation.  

    Who can enter?

    This Prize Promotion is open to all residents of the UK and Northern Ireland aged 18 or over.    Employees of the Promoter, their immediate families, and employees or immediate family members of any third-party companies associated with the promotion, prize providers or agencies assisting with the promotion operation may not enter any promotion. Proof of age may be required.

    In entering the Prize Promotion, you confirm that you are eligible to do so and eligible to claim any prize you may win.

    What do I need to enter?

    Purchase of a participating product required. A public profile on Instagram, as private entries will not be included. A camera enabled smartphone with internet access. 

     

    When does the promotion start and finish?

    The promotion will run from 00:00 on 18.02.2026 and will close at 23:59 GMT on 01.04.2026. No entries will be accepted after the Closing Date.

     

    The promotion will be available on Air Wick social media posts featured on Instagram.

    Only one entry per profile per day on the Instagram platform is permitted . If you enter more than once per day, you will be disqualified. Entries that have been generated by an automatic means will also be void.

    The Promoter is not liable for:

     

    Any entries lost or delayed due to faulty, failed, or erroneous electronic data transmissions, including but not limited to communication line failure, regardless of cause, involving equipment, systems, networks, satellites, servers, computers, or providers used in any aspect of this Promotion causing delays or disruption, as well as entries lost, delayed, corrupted, damaged, misdirected, or incomplete, or unable to be delivered for any technical, delivery, or other reason, will not be considered. Proof of transmission will not suffice as proof of receipt of entry to the Promotion. Inaccessibility or unavailability of the internet will also not be considered as grounds for exception.

    Additional Terms, Tier One:

     

    • The holidays are valid for travel until 31 st March 2027 excluding travel over Christmas, Easter and all bank holidays.  
    • All holiday locations and dates are subject to availability. Travel will be subject to flight and hotel availability at the date of booking the trip. The winner should notify the Promoter at least six weeks in advance of his/her preferred dates for taking the trip.  Neither the Promoter nor Cloud Nine can guarantee the Prize will be available on the Winner’s requested dates.
    • All travel must be completed within the time-frame stated within the competition. Extensions to the validity of the prize will not be allowed unless first authorised by the promotional agent. 
    • The Promoter or Cloud Nine will accept no responsibility for hotels / tours / transport companies etc. being withdrawn or amended.  In the event of this, Cloud Nine will endeavour to offer a suitable alternative.
    • All travel arrangements offered are at the discretion of Cloud Nine and the promoter. Any requests relating to airport, airlines or hotels cannot be guaranteed.
    • Any amendments made by the prize winner after the booking is confirmed may be subject to administration charges levied by the specific supplier.
    • Passports and Visas are the responsibility and cost of the prize winner.  The Promoter or Cloud Nine cannot be held responsible if the prize winner or any of the travelling party fail to obtain the required travel documentation.
    • There is no cash alternative or refund for unused portions of the prize.
    • Travel insurance is not included in the prize and is the responsibility of the winner to arrange; proof of valid travel insurance will be required prior to departure.
    • The winner and their guest are responsible for complying with all health, safety, and travel requirements applicable at the time of travel, which may include vaccinations, testing, quarantine, or other protocols mandated by relevant authorities or travel providers. Any associated costs for this are the responsibility of the prize winner and their party (where applicable).
    • The winner and their guest(s) agree to adhere to all local laws and guidelines during their stay.
    • For the avoidance of doubt, the prize does not include travel to and from home to the airport, gratuities, meals or other  travel expenses unless otherwise stated, or any other costs of a personal nature not stated for winner and guest. 
    • The Promoter is not responsible for any losses, injuries, or damages arising from the acceptance or use of the prize.
    • Bookings must be made through Cloud Incentives Ltd, Market House, Silver End, Olney, MK46 4AL (ABTA number: L9097 / ATOL number: 10626), www.uponcloudnine.co.uk.  

     

    Additional Terms, Tier Two:

     

    • Digital Gift Cards are subject to the retailers own terms and conditions.
    • Gift cards can not be replaced if lost or stolen.
    • Gift cards are valid for 12 months from the date of receipt.
    • Spa Escape Vouchers are bookable through Cloud Nine Incentives Ltd. Vouchers can be used against a UK spa break of the winners choice.

    No cash or other alternative prize will be provided in whole or in part, except that in the event of circumstances outside of its control the promoter reserves the right to substitute a similar prize of equal or greater value. The prize is non-transferable and cannot be exchanged for any cash alternatives in whole or in part. 

    How are winners selected?

    All eligible entries will be entered into the prize draw. The winners will be independently selected via a randomised computer process within seven working days of the close date (01.04.26). 

     

    How are winners notified?

    Winners will be notified by direct message via the Instagram account used to enter, within seven working days of being selected. The message will contain details on what they have won and how to claim.

    If for any reason winners are contacted via social channels, they will ONLY be contacted by the @AIRWICKUK official account, and we will NOT ask for personal details, including bank details under any circumstances. 

    The Promoter will make reasonable efforts to contact winners. However, if a winner has not responded to notification within fourteen (14) working days of the first attempt, or if a selected winner is ineligible, in breach of these rules, or unable to take up the prize for any other reason, an alternative winner will be drawn using the same methodology as above. The process will repeat until an eligible winner is able to claim the prize. Entrants are encouraged to monitor their connections during this time in case they are a winner. The 

    Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

     

    How are prizes fulfilled?

    Tier One winner will contact Cloud Nine Incentives to arrange travel reservations.

    Tier two prizes will be emailed. All prizes will be dispatched to winners within 28 days of acknowledgment of the prize notification and any verification process. 

    Prizes returned undelivered are assumed unwanted and an alternative winner will be drawn. A UK delivery address will be required.

    Publicity:

    The winner may be requested to take part in media activity relating to the competition (if requested). The promoter may request to use the winner’s name and image in connection with such publicity unless the winner notifies the Promoter that it does not want its name and/or image to be used in this way.

     

    Winners List:

    If required by a regulatory authority, and/or if we consider it lawful, necessary, or appropriate to do so, we may elect to make available a list of winner’s surnames and/or county to regulators who request such details within 3 months of the closing date of this Promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting airwick@uponcloudnine.co.uk. We may still be obligated to disclose the information to the Advertising Standards Authority if required to do so.     Proof of ID and verification:

    The entrant entering the promotion must be the owner of the Instagram account used. Proof of ownership of the social media account and proof of age may be required. 

     

    The Promoter may need to verify entries including but not limited to asking for proof of address, age and identity details (which must be provided within 7 working days) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, the spirit of the promotion, or any instructions forming part of this promotions entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.

     

    Legal and liability:

    Any entries received from private accounts on Instagram will not be entered due to privacy restrictions. To enter from a private account, participants must amend their account settings to a public account for their entry to be accepted.

    By entering this competition, the entrant confirms and warrants that the submitted work is entirely their own original creation and has not been created, in whole or in part, using any artificial intelligence (AI) or machine learning tools or systems.

     

    The Promoter reserve the right to request proof of the original creative process (e.g., source files, drafts, process documentation) to verify compliance with the no-AI clause .

    By submitting an entry, each participant grants the Promoter an irrevocable, worldwide, royalty-free licence to use the copyright and any other intellectual property rights in their entry for all purposes related to this Promotion. This includes, without limitation, displaying the entry on the Promoter’s website and any other websites or social media channels operated by the Promoter, as well as using the entry, or any part of it, in marketing materials connected with this Promotion.

    This promotion is in no way sponsored, endorsed, or administered by META Group or any its associated companies.

    The Promoter or Cloud Nine shall not be liable to any Winner or any guest of a Winner in the event that a Winner and / or the Winner’s guests are unable to use the Prize, either in whole or in part, due to (i) the Winner not booking their Prize in accordance with these terms, (ii) the Winner and / or the Winner’s guests not attending the holiday or (iii) the Winner and / or the Winner’s guest failing to arrive at a venue or other place at the time notified to the Winner, to enable the Winner and the Winner’s guests to enjoy the prize.

     

    The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this Prize Promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any participants or third parties but will use all reasonable endeavours to avoid consumer disappointment.

    The Promoter and its associated agencies and companies accept no responsibility and shall not be liable for any loss, expense or damage (including, without limitation, indirect, special or consequential loss or loss of profits),  suffered or sustained in connection with this promotion or the acceptance or use or failure to use the prize/gift, whether arising in contract, tort (including negligence) or otherwise. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law (including personal injury, death caused by negligence or fraud or fraudulent misrepresentation) in which case that liability is limited to the minimum allowable by law.

    The Promoter has no control over internet and communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware, or software failures of any kind which may restrict, delay or prevent a participant’s entry to the Promotion.

    The Promoter’s decision is final regarding all promotional matters and no correspondence will be entered into.

    These terms and conditions and any related disputes shall be governed by the laws of England, Wales and , and subject to the jurisdiction of the courts of England, Wales.

    The Promoter will only use the personal details supplied for the administration of the Promotion and for no other purpose, unless we have your consent. The entrant’s personal details will at all times be kept confidential and in accordance with current Data Protection legislation. Click

    1. PRIVACY POLICY

    1.1 The Promotor is in the role of data controller responsible for the processing of personal data. The Promoter is committed to protecting the data privacy rights of all participants, in strict compliance with any applicable Data Protection Law in the UK, including the UK General Data Protection Regulation (UK GDPR), Electronic Communications Regulations 2003 (PECR) and the Data Protection Act 2018. The Promoter confirms that any personal data, processed in connection with the Promotion, will only be collected, saved or processed for the purposes of the administration of the “Dream Escape Giveaway” (hereinafter the “ Promotion”) unless participants have consented to the processing of their personal data for different purposes on our website(s), including direct marketing and sharing personal data with third-party controllers for the analysis of their consumption habits and their propensity to purchase.

    1.2  Categories of personal  data – Within the Promotion, the Promoter will collect from the participants the following categories of personal data through the profile on Air Wick’s page on Instagram: participants’ social handle / nickname of the designated social media account and response to the promotion. In case of the winner(s) the Promoter will further collect: participants’ full name, contact details (email address, phone number) and address for delivery of the prize. 

    1.3  Purpose of the processing and legal basis – Participants’ personal data submitted in connection with the Promotion will be processed by the Promoter for the purpose of administering and managing the Promotion and, in particular, to (i) allow participants to enter in the Promotion, (ii) administer the Promotion, and (iii) deliver the prize to winners. Legal basis for this processing of participants’ personal data are these Terms & Conditions, which represent a contractual agreement between participants and the Promoter [ art. 6 (1) (b) (UK) GDPR].

    1.4  Data retention – The Promoter will only retain participants’ personal data as long as reasonably required for the purposes as set out in this privacy policy or otherwise to comply with legal or regulatory requirements applicable to the Promoter. When participants’ personal data is processed (i) for the performance of a contract with the Promoter, the Promoter retains participants’ personal data for a period of 7 years following the end of the Promotion (solely for winners); (ii) for meeting legal and regulatory requirements, the Promoter retains participants’ personal data as it is set out by applicable laws; and (iii) in all other cases, participants’ personal data is processed for up to 2 years from the date of last interaction with participants (specifically for marketing purposes unless the participant opts-out from the newsletter distribution).

    1.5  Data sharing – Personal data collected within the Promotion will be accessed, as data processor(s), by our third-party vendor(s) providing support and assistance in relation to the Promoter’s website, database or IT services and software. For the management of the Promotion, we have further appointed as data processor based on relevant data processing agreement: Cloud Nine Incentives LTD (a company incorporated April 2011 with company number 07342147 having its registered office at NP-105, iCentre, Howard Way, Newport Pagnell, Milton Keynes, Buckinghamshire, MK16 9PY
    Notwithstanding the above, and in order to ensure transparency for the management of the promotion on social media, we state that, Meta is the controller of personal data of all users and visitors of the social network processed in general during its operation and also during the operation of other Meta products, such as Instagram and Facebook. At the same time, we would like to inform you that when managing the Promoter's profile on the social network, the Promoter and Meta may become joint controllers of your personal data, given that the social network provides the Promoter with so-called site overviews, which are summary of data about how people communicate with the Promoter 's profile on the social network (for example, information about the number of people that viewed the profile, commented on or responded to the organizer's posts on his social network profile, aggregated anonymized demographic data – e.g. age, city or gender of such persons etc.). Meta has the primary responsibility for processing the data from these reports in line with its Privacy Policy.     1.6  Transfer to other countries – Personal data may be transferred outside the UK and the EEA, including the USA, by our third party-vendors acting as data processors on our behalf. For the transfer of personal data outside the UK and the EEA, appropriate safeguards have been adopted, including Standard Contractual Clauses adopted by the European Commission, resp. the UK Addendum, and Binding Corporate Rules as applicable within UK.

    1.7  Children – Since individuals aged 18 and over can participate exclusively in the Promotion, no data belonging to persons under the age of 18 will be processed and stored. In the event that the Promoter receives personal data belonging to persons under the age of 18, this data will be immediately deleted/destroyed. If a parent or holder of the parental authority notifies the processing of personal data belonging to persons under the age of 18, the promoter will immediately delete/destroy this data from the processing and storage facilities.

    1.8  The protection of your personal data – The Promoter undertakes to implement appropriate technical and organizational measures in order to ensure a level of security corresponding to the personal data belonging to the participants of the Promotion. In assessing the appropriate level of security, account shall be taken in particular of the risks posed by the processing of personal data, caused in particular, by accident or illegally, by the destruction, loss, modification, unauthorised disclosure or unauthorised access to personal data transmitted, stored or processed. 

    1.9 Participants’ data protection rights – In connection with the processing of their personal data within the Promotion, participants have the following rights arising from the GDPR:
    •          the right of access to personal data including right to request a copy of personal data;
    •          the right to rectification (right to have their inaccurate personal data corrected or to have incomplete personal data completed without undue delay);
    •          the right to deletion (right to have their personal data deleted without undue delay, if one of the legal grounds is given);
    •          the right to restrict processing;
    •          the right to data portability (in cases stipulated by law, right to obtain their personal data provided to the Promoter in a structured, commonly used and machine-readable format, and the right to pass this data to another data controller);
    •          the right to object to the processing;
    •          the right not to be the subject of any decision based solely on automated processing
    •          the right to withdraw the consent at any time (provided that the processing was based on consent).
